Lost and stolen Bank Card: Liability

Your liability before reporting the issue:

You may be liable for unauthorised transactions only up to a limited amount before reporting the loss. If someone makes money transfers with a stolen card before the loss or the theft has been reported, the account holder is liable for a maximum amount of 50 € (under EU law PSD2).

Provided that:

  • you did not act fraudulently, and
  • you did not act with gross negligence

Some banks offer exemption from liability. Take a look at the general terms and conditions to know what you are liable for in the event of theft or loss.

Your liability after reporting the issue:

Once you have reported the loss and you card has been blocked, you are not liable for any unauthorised transactions. Your bank must refund generally any losses.

Exception: Gross Negligence

Problems arise when the damage is caused due to gross negligence. This is the case for example, when:

  • keeping your PIN code on a Note together with your card
  • you wrote down your PIN code on the card
  • sharing you PIN with others
